A

Scope of Application

  • The Rules apply exclusively to all officials and employees of the Office of the Ombudsman.

Definitions

  • Protected Disclosure: Voluntary, deliberate disclosure by an official or employee about actual, suspected, or anticipated wrongdoing within the OMB.
  • Whistleblower: An official or employee who makes a protected disclosure to a supervisor, superior, the Tanodbayan, or the Internal Affairs Board (IAB).
  • Retaliatory Action: Negative or obstructive actions against whistleblowers or their relatives within the fourth civil degree due to disclosures, including legal proceedings, forced resignation, negative evaluations, ostracism, and other adverse treatment.

Permissible Reports and Whistleblower Rights

  • Reports may concern acts or omissions contrary to laws, rules, regulations; unfair or oppressive acts; or improper exercise of powers.
  • Whistleblowers are shielded from criminal, administrative, or civil liability related to protected disclosures.
  • They have the defense of absolute privileged communication in case of actions arising from their disclosures.
  • Disclosure of confidential information under oath or rules does not constitute a breach if it is a protected disclosure.

Confidentiality and Testimony

  • Whistleblower identity, the subject matter, and the recipient of the disclosure must remain confidential at all times.
  • However, whistleblowers can be compelled to testify if necessary for prosecution.
  • Officials receiving disclosures must maintain confidentiality except when disclosure is consented to by the whistleblower, essential for proceedings, or mandated by the Rules.

Protection from Retaliation

  • Whistleblowers are protected from any form of disciplinary or retaliatory action such as reprimands, punitive transfers, poor evaluations, denial of promotion, or public humiliation.
  • Officials refusing to carry out retaliatory orders are also protected.

Conditions for Protected Disclosure

  • Must be voluntary, in writing, and under oath.
  • Must concern matters not already under investigation unless necessary for the prosecution or new evidence.
  • The whistleblower must assist and participate in associated proceedings.
  • Disclosure should include sufficient particulars and supporting evidence where possible.

Unprotected Disclosures

  • Matters under official investigation by the disclosing official.
  • Groundless or baseless disclosures.
  • Disclosures on office policy merits.
  • False or misleading disclosures and disclosures later retracted by the whistleblower.
  • Such disclosures bear no immunity and no benefits.

Disclosures by Parties to Misconduct

  • Allowed if:
    • Compliance with conditions for protected disclosure is met.
    • Whistleblower is not the most culpable party.
    • No prior conviction involving moral turpitude.
    • Whistleblower testifies according to their disclosure.

Obligations of Officials Receiving Disclosures

  • Maintain confidentiality of whistleblower and subject matter.
  • Protect the welfare of the whistleblower.
  • Report the disclosure promptly to the IAB Chairman and/or Tanodbayan within five days.

Procedure for Handling Protected Disclosures

  • The IAB must immediately evaluate if the disclosure qualifies as protected.
  • Process disclosures per the required conditions.
  • Conduct necessary actions according to Administrative Order No. 16.

Obligation and Protection of Witnesses

  • Officials with knowledge of subject matters must testify when called.
  • Such witnesses receive the same protection from retaliation as whistleblowers.

Incentives for Whistleblowers

  • Whistleblowers may receive commendations, promotions, and other incentives as deemed appropriate.

Remedies and Sanctions

  • Violations of confidentiality by officials will result in disciplinary sanctions.
  • Retaliatory actions lead to administrative/criminal proceedings and possible preventive suspension.
  • Failure to report or act on disclosures is subject to disciplinary action.
  • Failure or refusal to testify or giving adverse testimony without just cause is punishable.
  • False or misleading disclosures lead to loss of whistleblower benefits including immunity.

Effectivity

  • The Rules came into effect 15 days after publication in the Official Gazette and upon filing certified copies with the University of the Philippines Law Center.
