Legal basis, policy, and authority
- The President acts pursuant to Section 90 of Commonwealth Act No. 1, as amended.
- The order is grounded on the hazardous nature of activities connected with underwater naval operations, including deep-sea diving and underwater demolitions.
- The order expressly recognizes extraordinary hazards and risks arising from activities involving bomb disposal, fused bombs, mines, torpedoes, booby traps, lethal devices, and preparation/testing of explosives, incendiaries, poison gases, and radioactive materials.
- The order also covers testing of new and dangerous equipment connected with underwater operations and hazardous military research and development.
Scope of hazardous duty pay
- Hazardous duty pay is authorized for officers of the Armed Forces of the Philippines.
- Payment is allowed while performing hazardous duty under rules and regulations prescribed by the Secretary of National Defense.
- The hazardous activities contemplated include:
- Deep-sea diving in underwater naval operations,
- Arming, disarming, or disposal of fused bombs, mines, torpedoes, booby traps, and other lethal devices,
- Preparation or testing of lethal materials or devices such as explosives, incendiaries, poison gases, and radioactive materials,
- Testing of new and dangerous equipment,
- Underwater demolitions.
- Hazardous duty pay is payable only when all conditions for entitlement and eligibility under the applicable rules are met.
How entitlement is requested and approved
- Hazardous duty pay is provided under rules and regulations prescribed by the Secretary of National Defense.
- Requests for hazardous duty pay must contain a description of the hazardous duty performed.
- Requests must include the period covered by the hazardous duty.
- Requests must include the place where such duty was performed.
- Requests must be attested to by the commander or officer-in-charge of the officer applicant.
- Requests must follow these required contents as part of the eligibility requirements under the Secretary of National Defense’s rules.
Amount, payment timing, and funding
- Hazardous duty pay is equivalent to fifty per centum (50%) of the officer’s respective base pay.
- Hazardous duty pay is paid monthly.
- Hazardous duty pay is payable subject to the availability of funds.
Exclusions and rescission
- Officers receiving flying pay or jump pay are not entitled to hazardous duty pay.
- Executive Order No. 437, dated July 10, 1961, is rescinded.
