Policy, purpose, and state action
- The State adopts a policy to ensure the sustainable development of Boracay Island as a priority tourism destination under Section 1.
- Government must plan, undertake, and cause implementation of support projects and programs to preserve Boracay’s attractiveness and the adjoining islands or areas as a tourism destination under Section 1.
Special Tourism Zone proclamation
- Boracay Island is proclaimed as a Special Tourism Zone under Section 2.
Eminent Persons Group creation
- A group of eminent persons is recognized to oversee the sustainable development of Boracay tourism on behalf of the President and the Secretary of Tourism under Section 3.
- The President of the Philippines shall designate the Boracay Eminent Persons Group from among the eminent persons under Section 3.
- The Group must ensure effective implementation of the sustainable development policy under Section 3.
Geographic and activity coverage
- The territorial scope of Boracay tourism covers the island of Boracay consisting of three (3) barangays: Yapak, Balabag, and Manok-Manok, all islets around Boracay, and Barangay Caticlan in the Municipality of Malay in Mainland Panay Island under Section 4.
- The principal area of activity of the Eminent Persons Group is Boracay Island under Section 5.
Powers and functions
- The Eminent Persons Group must formulate plans for the sustainable development of tourism in Boracay under Section 6(a).
- The Group must recommend to the Philippine Tourism Authority rules and regulations necessary to ensure compliance with the requirement of the island’s sustainable development under Section 6(b).
- The Group must advocate sustainable-development policies to the people of Boracay, their barangay/municipal/provincial elected officials, and the national government under Section 6(c).
- The Group must prioritize major projects of Boracay consistent with its sustainable development plans under Section 6(d).
- The Group must coordinate enterprises within Boracay needed for sustainable development under Section 6(e).
- The Group must cause proper land use projects and practices for Boracay and its marginal islands under Section 6(f).
- The Group must ensure preservation of the island’s natural and cultural heritage under Section 6(g).
Private-sector character rule
- As long as the Eminent Persons do not require government funding for their activities, they retain their private sector character under Section 7.
- If they request and receive government funding for their activities, they acquire the nature of government officials under Section 7.
Group Secretary, staffing, and funding
- The Group shall be serviced by a Group Secretary under Section 8.
- The Group Secretary must be a government official appointed by the President of the Philippines under Section 8.
- Compensation and operating expenses of the Group Secretary must be appropriated from the funds of the Philippine Tourism Authority under Section 9.
Separability, repeals, and effectivity
- Separability: If any portion is declared unconstitutional, the remainder continues to have effect if it can still subsist and be given effect in its entirety under Section 10.
- Repealing clause: All orders, rules and regulations, and issuances (or parts) inconsistent with the Executive Order are revoked, amended, or modified accordingly under Section 11.
- Effectivity: The Executive Order takes effect immediately under Section 12.
