Role of Municipal Treasurers in Fee Collection

- Collected funds must be paid into the Insular Treasury with monthly reporting to the Director of Lands.

Regulatory Authority of Director of Lands

Prohibition on Direct Fee Collection by Surveyors
- Private surveyor corporations are prohibited from collecting fees directly from land occupants or claimants.
- Violation of this results in cancellation of the survey assignment and forfeiture of the performance bond.
Appropriation and Loans for Survey Corporations
- An appropriation not exceeding PHP 100,000 is set aside for loans to corporations of private surveyors under this Act to assist in completing cadastral work.
- Director of Lands may grant loans with legal interest secured by fees collected or to be collected.
- Loans cannot exceed 75% of total fees collected and outstanding.
- Loans are to be repaid from fees collected by municipal treasurers.
Payment Procedures for Survey Fees Without Loans
- Director of Lands orders payment of fees for cadastral surveys not covered by loan guarantees, ensuring monthly payments until full payment completion.
Obligations of Occupants or Claimants in Monumenting
- Occupants or claimants within cadastral zones must cooperate in monumenting lot corners by concrete monuments provided by the local cadastral office.
- Monumenting performed under supervision of cadastral office surveyors or assistants, beginning 30 days after cadastral survey publication.
Applicability of Act No. 2259 Provisions
- All provisions of Act No. 2259 not inconsistent with this Act apply to cadastral surveys executed under this law.
Supervision and Compliance
- Director of Lands mandated to supervise field and office work of cadastral surveys to assure legal compliance and adherence to Bureau of Lands regulations.
Repeal and Transitional Provisions
- Act No. 2989 repealed except for ongoing private cadastral surveys at the time of this Act's approval.
- Existing surveys by private surveyors not incorporated per this Act continue until completion.
Effectivity
- The Act takes effect immediately upon approval on December 6, 1926.
