Guarantee of Loan Repayment and Obligations
- The President is authorized to provide an absolute and unconditional guarantee for the repayment of the loan(s).
- This guarantee is as the primary obligor and not merely as a surety.
- It covers payment obligations and all other responsibilities of the Republic under agreements related to the telecommunications project.
Power to Enter into Agreements and Terms
- The President may enter into agreements with the specified foreign financial institutions or corporations under terms deemed appropriate.
- Such agreements are aimed to effectively implement the telecommunications expansion and improvement objectives.
Limit on Loan Amount
- The total principal amount of contracted or guaranteed loans shall not exceed twelve million U.S. dollars or its equivalent in other currencies.
Creation of a Procurement Committee and Bidding Process
- A committee is established chaired by the Deputy Auditor General, with members including Deputy Commissioner of the Budget, Director of the Bureau of Telecommunications, Secretary of General Services, and Chairman of the National Power Board.
- The committee is tasked with canvassing prices of telecommunications equipment.
- It recommends procurement by public bidding, ensuring favorable prices and quality to the government.
- Public bidding must be conducted within the Philippines.
Tax and Duty Exemptions for Agreements
- Agreements entered pursuant to the Act may provide exemption from all taxes, contributions, restrictions, and other levies imposed by the national government, provinces, cities, and municipalities.
Tax Exemptions for Loans
- Loans contracted under the Act are exempt from any taxes, duties, fees, imposts, charges, and restrictions imposed by all levels of government.
Exemption of Telecommunications Equipment from Taxes and Duties
- Telecommunication equipment and accessories procured and imported must be brand new and latest model.
- Such equipment is exempt from all forms of taxes, duties, fees, imposts, charges, contributions, and restrictions from all government levels.
Execution and Operation of the Project by the Bureau of Telecommunications
- The Bureau of Telecommunications is responsible for the execution and subsequent operation of the nationwide project.
- Projects in municipalities and barrios require prior consent from the respective municipal and barrio councils.
Funding Sources for Peso Counterpart Funds
- The Bureau of Telecommunications' required peso counterpart funds shall be sourced from economic development bonds issued under Republic Act No. 1000.
- Other funds of the Republic may also be used.
Effectivity of the Act
- The Act takes effect immediately upon approval.
