Subdivision and Survey Requirements
- Prior to sale, the Director of Lands must subdivide the property into smaller lots per a subdivision plan prepared by him.
- The subdivision plan must include necessary alleys for fire escape and other purposes.
- Cost of survey and subdivision shall be part of the purchase price.
- Excess land (areas greater than 200 square meters occupied by present occupants) must be allocated to other actual occupants made available through alley constructions.
Selling Price, Payment Terms, and Interest
- Selling price capped at no more than PHP 5.00 per square meter.
- Purchasers may pay without down payment over 15 years in 180 equal monthly installments.
- Annual interest of 4% is applied on all installments due and payable.
- Alternative payment options include cash payment or multiple installments at any time.
Restrictions on Alienation and Encumbrance
- Lands purchased cannot be encumbered or alienated to anyone except the government, its branches, institutions, or legally constituted banking corporations within 15 years from issuance of transfer certificate of title.
- The property shall not satisfy any debt contracted prior to the expiration of this 15-year restriction period.
Forfeiture and Reversion
- Any agreement or contract violating the provisions of this Act will result in reversion of the property to the government and forfeiture of all payments made.
Succession and Default
- Upon death of purchaser before full payment, widow and children succeed to the rights and obligations regarding the lot.
- Failure to pay six consecutive or cumulative installments triggers the Director of Lands’ duty to sue for recovery.
- The government may enforce lien and sell the lot in foreclosure manner.
- Only persons not owning residential lots in Manila, Quezon, Pasay, or their suburbs, and qualified to acquire public lands may participate in auction sales.
- Auction purchaser obtains good and indefeasible title.
Implementation and Regulatory Authority
- The Bureau of Lands is responsible for implementing the Act.
- The Director of Lands may issue necessary rules and regulations to enforce the law.
Repeal and Effectivity
- Laws or parts inconsistent with this Act are repealed or modified accordingly.
- The Act takes effect upon approval (June 20, 1964).
