Legal Authority and Basis
- Issued under paragraph (f) of Section 301 of the Tariff and Customs Code, as amended by Republic Act No. 8752.
- The Department of Trade and Industry (DTI) has the authority to conduct preliminary determinations on anti-dumping petitions.
Findings and Determination
- Preliminary affirmative finding of dumping by Indonesian exporters of mosquito coils.
- Dumping margin determined at 0.40 US$/kg for Johnson Home Hygiene Products (JHHP) and all other exporters.
Imposition of Provisional Measures
- Provisional anti-dumping duty imposed in the form of a cash bond.
- Duration of provisional measure: Four (4) months from the effectivity of the Order.
Next Steps and Formal Investigation
- The petition will be forwarded to the Tariff Commission for a formal investigation.
- The investigation will determine the necessity of imposing a definitive anti-dumping duty.
Effective Date and Publication Requirements
- The Order takes effect upon issuance of a relevant Memorandum Order by the Bureau of Customs or 15 days after publication in two newspapers of general circulation, whichever comes earlier.
- Mandatory publication in two newspapers ensures public notice.
Notification Procedures
- Individual notices shall be sent to all interested parties including the country member concerned (Indonesia).
Administrative Compliance
- The Order is to be complied with by the Bureau of Customs and other relevant agencies.
- The Commissioner of Customs, Napoleon L. Morales, signed and adopted the Order on April 26, 2010.
