Penalties for Failure to Register
- Reservists who fail to register without lawful justification are subject to prosecution.
- Upon conviction by a military court, penalties include confinement at hard labor for up to one year and/or a fine not exceeding one thousand pesos.
Duties of the Local Civil Registrar
- Must forward copies of all registration documents to the Chief of Staff, AFP.
- Must report immediately any deaths of individuals known or publicly known to be AFP reservists.
- Required to notify AFP prior to issuance or validation of passports or travel clearances for reservists intending to leave the country.
Role of the National Computer Center
- Provides technical assistance for updating and analyzing records of AFP reservists.
Security of Tenure for Reservists Employed in Private Sector
- Employees in private firms with at least twenty employees and an annual gross revenue of no less than 250,000 pesos who undergo refresher training, mobilization, assembly tests, or annual active duty training shall not lose their jobs or pay.
- Employers may claim salaries paid during such periods as deductible expenses in income tax returns.
Penalties for Employers and Officials Interfering with Military Obligations
- Employers or public officials preventing employees from fulfilling military training obligations face imprisonment up to six months and/or a fine up to one thousand pesos.
Mailing Privileges for AFP Communications
- AFP may send official communications related to this Decree free of charge.
- Official mail must be properly marked, warning against unauthorized use.
- Unauthorized use of this privilege is punishable by a fine of 500 pesos and/or imprisonment up to three years.
Superseding Conflicting Laws and Immediate Effectivity
- All laws, rules, or regulations inconsistent with this Decree are modified or amended accordingly.
- The Decree takes effect immediately upon issuance.
Enforcement Directive
- The AFP issued the GHQ OMRA/AGAL Directive to facilitate enforcement of this Decree, particularly the annual registration requirement.
