Drawing of Lots to Determine Winner
- The tied candidates' names are subjected to a drawing by the provincial board of canvassers.
- The candidate favored by this drawing is proclaimed elected.
- The proclaimed candidate is entitled to the seat in the National Assembly as if they had won by a majority vote.
Notice and Public Session for the Drawing
- Upon determination of a tie, the provincial board of canvassers must state the tie in the official certificate.
- All candidates involved in the tie must be given ten days' notice to be present at the drawing, should they wish to attend.
- A public session is held for the purpose of conducting the drawing.
Documentation and Distribution of Results
- Minutes documenting the procedures followed, the outcome of the drawing, and the proclamation of the winning candidate must be prepared immediately following the drawing.
- Certified copies of these minutes are sent to the National Assembly, the President of the Philippines, the Auditor General, and each of the tied candidates.
Effectivity of the Act
- The Act takes effect immediately upon approval, ensuring prompt resolution of electoral ties for the National Assembly.
