Key definitions for compliance
- Lactation station means a private, clean, sanitary, and well-ventilated room or area where nursing mothers can wash up, breastfeed or express milk comfortably, and store the milk afterward.
- Land transport terminal/station means a passenger station and a place for the final stopover or a permanent station, office, and yard of public utility vehicles, which may also serve as a loading and unloading area for passengers.
- Land transport stop means a common place for the stopover of public utility vehicles located along highways or a regular route for long-distance travel.
- Rest area means a facility located at a strategic point along the national highway or route of the travelling public with parking space, restaurants or snack bars, other business shops, recreational facilities, service stations, public restroom facilities, or waiting sheds for travellers or commuters.
- RORO terminal means a terminal that is part of the Road Roll-On/Roll-Off system.
- Sanitary facilities means a set of facilities that includes at least a combination of comfort room and hand-washing facilities as detailed in Section 4.
Free internet obligation
- The Department of Information and Communications Technology (DICT), in coordination with the Department of Transportation (DOTr) and other concerned stakeholders, must ensure that free internet is provided in land transportation terminals, stations, stops, rest areas, and RORO terminals.
- Owners, operators, or administrators of these establishments must fully ensure the speedy and efficient implementation of the free internet provision.
- The free internet obligation is implemented pursuant to Republic Act No. 10929 (the “Free Internet Access in Public Places Act”).
Mandatory sanitary facilities standards
- Owners, operators, or administrators must provide clean sanitary facilities for passengers in land transport terminals, stations, stops, rest areas, and RORO terminals.
- Sanitary facilities must include all of the following minimum components:
- Separate restrooms for persons with disabilities (PWDs), male, and female passengers;
- Adequate ventilation and lighting;
- Safe, adequate, and running water supply;
- Flush system;
- Toilet seat with cover;
- Lavatory with toilet paper, mirror, soap, hand dryer, and door lock;
- Waste bin; and
- Exclusive space for diaper-changing.
- In implementing sanitary facilities, owners, operators, or administrators must comply with the applicable standards under Presidential Decree No. 856 (the “Code on Sanitation of the Philippines”).
- The DOTr, in coordination with relevant government agencies, must conduct random ocular inspections to ensure compliance with the sanitary facilities requirement.
No fees for regular sanitary use
- Collecting fees from passengers for use of regular sanitary facilities in the establishment is unlawful.
- For passengers to avail of the free use of sanitary facilities, the passenger must show the paid bus ticket for the day.
- The prohibition does not apply to separate, well-appointed or deluxe sanitary facilities operated solely for commercial purposes and for the convenience of passengers who require and prefer such facilities within land transport terminals, stations, stops, rest areas, and RORO terminals.
Lactation station requirement
- Owners, operators, or administrators must establish at least one (1) lactation station in land transport terminals, stations, stops, rest areas, and RORO terminals.
- The lactation station must be separate from the sanitary facilities.
- Lactation stations must be clean and must comply with the applicable provisions of Republic Act No. 7600, as amended by Republic Act No. 10028 (the “Expanded Breastfeeding Promotion Act of 2009”) and its rules and regulations.
- The DOTr, in coordination with the Department of Health (DOH) and other relevant government agencies, must conduct random ocular inspections to ensure compliance.
Penalties and fine assessments
- An owner, operator, or administrator that does not comply with the sanitary facilities standards under Section 4 is liable for a fine of PHP 5,000.00 for each day of violation.
- An owner, operator, or administrator that violates the prohibition on collecting fees under Section 5 is liable for a fine of PHP 5,000.00 for each day of violation.
- An owner, operator, or administrator that does not provide and maintain a lactation station as required under Section 6 is liable for a fine of PHP 5,000.00 for each day of violation, in addition to the sanctions under Section 21 of the “Expanded Breastfeeding Promotion Act of 2009.”
- The Land Transportation Franchising and Regulatory Board (LTFRB) must, after five (5) years from the effectivity of the Act and once every five (5) years thereafter, review the applicability and enforcement of the fines and the necessary adjustments on the amount of the fine imposed, subject to approval of the Secretary of the Department of Transportation.
Implementing rules and coordination
- The DOTr, in coordination with the DICT, LTFRB, DOH, the Philippine Ports Authority, and other concerned stakeholders must jointly promulgate the necessary Implementing Rules and Regulations to carry out the Act.
- The joint promulgation must occur within sixty (60) days from the effectivity of the Act.
Repeal and effectivity rules
- All laws, decrees, executive orders, or parts thereof inconsistent with the Act are repealed, amended, or modified accordingly.
- The Act takes effect fifteen (15) days after its publication in the Official Gazette or in at least two (2) national newspapers of general circulation.
Issuance details and approval timeline
- The Act is Republic Act No. 11311, titled “Land Transport Terminals Improvement Act.”
- The Act was approved on April 17, 2019.
- The Act appears in 115 OG No. 26, 6246 (July 1, 2019).
- The Act was passed by the Senate as Senate Bill No. 1749 on July 24, 2018 and adopted by the House of Representatives as an amendment to House Bill No. 725 on January 29, 2019.
