Authority of the Governor-General to Remove Ineligible Office Holders
- The Governor-General is empowered to summarily remove any person from provincial or municipal office or employment if satisfactory proof is presented that the person is ineligible to hold such position.
- This provision strengthens enforcement against ineligible officeholders.
Confirmation of Election and Grounds for Refusal
- Upon filing of election certificates with the Executive Secretary, the Governor-General shall confirm the election of provincial elective officers unless there is an unresolved election contest in court.
- The Governor-General may withhold confirmation until a certified court decision is filed.
- Confirmation may be refused on reasonable grounds of suspected disloyalty, moral unfitness, or bad reputation regarding morality, honesty, and uprightness in the community.
- If confirmation is refused, with the advice and consent of the Philippine Commission, the Governor-General may appoint a suitable person to fill the vacancy for the full term or call a special election.
- The person whose confirmation was refused is disqualified from running in the special election, and votes for that person shall not be counted or canvassed.
Expedited Legislative Procedure
- The act's passage is expedited for the public good, in accordance with an earlier act prescribing legislative procedure.
Effectivity
- The act takes effect immediately upon its passage on September 27, 1907.
