Due Process Requirements Prior to Deportation or Expulsion
- The Governor-General or authorized agents must conduct a prior investigation before any deportation, expulsion, exclusion, or repatriation.
- The foreigners concerned must be given a hearing.
- The foreigners must be informed of any charges against them.
- They must be granted a minimum of three days to prepare their defense.
- They have the right to be accompanied by counsel and witnesses during the hearing.
- They must be allowed to cross-examine prosecution witnesses.
Exclusions and Limitations
- The Act explicitly prohibits the application of its provisions to Filipinos; no form of expulsion, including extradition, banishment, or deportation, shall be authorized against Filipino citizens.
Repeal of Conflicting Laws
- All previous Acts and legal provisions inconsistent or incompatible with the provisions of this Act are repealed.
Effectivity Clause
- The Act takes effect immediately upon its passage, pursuant to section one of Act Numbered 1945 of the Philippine Legislature, emphasizing the urgency and public need for its enactment.
