Required statement, oath, and filing
- The option to elect Philippine citizenship must be expressed in a statement that the party concerned must sign and swear to before any officer authorized to administer oaths.
- The signed and sworn statement must be filed with the nearest civil registry.
- The party concerned must accompany the statement with an oath of allegiance to the Constitution and the Government of the Philippines.
- The officer before whom the statement is sworn must be authorized to administer oaths.
Statement by persons abroad (US officers)
- If the party concerned is absent from the Philippines, the party may make the authorized statement before any officer of the Government of the United States authorized to administer oaths.
- When the statement is made before a United States officer due to absence from the Philippines, the party must forward the statement, together with the oath of allegiance, to the Civil Registry of Manila.
Filing fee requirement
- Section 3 requires the civil registrar to collect ten pesos as filing fees for the statement.
Fraud and falsehood penalties
- Section 4 imposes a penalty on anyone found guilty of fraud or falsehood in making the statement prescribed by the Act.
- The penalty under Section 4 is prisión correccional, or a fine not exceeding ten thousand pesos, or both.
- Liability attaches specifically to fraud or falsehood in the making of the required citizenship option statement.
