Licensing for Vessels in Lighterage and Harbor Business

  • Vessels classified under section 1 of Act No. 1136 must obtain a license to engage in lighterage or harbor-exclusive activities.
  • Licenses must be secured before engagement and renewed annually.
  • The collectors of customs at ports of entry issue these licenses.
  • Fee: ₱1.00 per registered net ton per license.
  • Licenses specify the port or body of water within which the vessel may operate.
  • Vessels are prohibited from transporting cargo or passengers for hire beyond the licensed area.

Revocation of License

  • The Collector of Customs for the Philippine Islands has the authority to revoke any license issued under this Act for cause at any time.

Retroactive Effect and License Fee Adjustments

  • The Act applies retroactively to all licenses due from July 1, 1905.
  • Licensees who paid fees under previous laws since that date are entitled to a refund equal to the difference between the old fee and the current fee under this Act.
  • Appropriations are made from the Insular Treasury to cover these refunds.
  • Licenses must be issued under this Act where fees have become due but remain unpaid from the same date.

Repeal of Conflicting Laws

  • All laws or parts thereof in conflict with this Act are repealed.

Expedite Passage and Effectivity

  • The enactment follows an expedited procedure as authorized by a prior Act (September 26, 1900).
  • The Act takes effect immediately upon its passage on September 5, 1905.
