Republic Act No. 11935 amends Republic Act No. 9164, postponing the December 2022 Barangay and Sangguniang Kabataan elections to October 2023 and every three years thereafter, with incumbent officials remaining in office until their successors are elected and qualified.

Law Summary

Commencement of Term of Office

  • The term of office for officials elected in these elections begins at exactly noon on November 30 following the election.

Hold-Over Provision for Incumbent Officials

  • Incumbent barangay and SK officials will continue to hold office until their duly elected successors have qualified.
  • Incumbents may be removed or suspended for cause before the successors assume office.
  • Officials who are ex officio members of the sangguniang bayan, panlungsod, or panlalawigan shall continue to serve in these councils until the next barangay and SK elections, unless removed for cause.

Appropriations for Election Implementation

  • Funds necessary for the enforcement of the law will be sourced from the Commission on Elections (COMELEC) appropriations as provided under the General Appropriations Act or any supplementary appropriations.

Separability Clause

  • In case any part or provision of the Act is declared unconstitutional, all unaffected parts shall remain fully in force and effect.

Repealing Clause

  • All laws, acts, decrees, orders, issuances, proclamations, rules, and regulations inconsistent or contrary to any provision of this Act are hereby repealed, amended, or modified accordingly.

Effectivity of the Act

  • This Act takes effect immediately after its publication in the Official Gazette or in two newspapers of general circulation.
