Exclusions from Coverage
- Employees whose official working hours are between 6:00 AM and 6:00 PM are excluded.
- Work beyond standard 8-hour shifts paid as overtime, governed by existing laws and regulations.
- Employees required to be on call 24 hours, such as uniformed personnel of AFP, PNP, BJMP, BFP, and similar agencies, are excluded.
- Civil Service Commission and Department of Budget and Management to identify similarly situated employees for exclusion.
Rules and Regulations for Implementation
- Civil Service Commission, in coordination with the Department of Budget and Management, tasked with promulgating implementing rules.
Funding and Appropriations
- Initial implementation costs for national government entities charged against existing appropriations; future costs to be included in annual General Appropriations Act.
- Local Government Units to fund through their respective funds, subject to provisions of the Local Government Code of 1991.
- Government-owned or -controlled corporations will charge the cost against their corporate funds.
Legal Clauses
- Separability Clause: Invalid provisions do not affect the validity of the remainder of the law.
- Repealing Clause: Amends Section 18 of Republic Act No. 8305; repeals or modifies inconsistent laws, decrees, orders, or regulations.
Effectivity
- Act becomes effective fifteen days after publication in the Official Gazette or two newspapers of general circulation.
