Policy and purpose framework
- Section 1 declares the State policy to accelerate social, economic, and political development of LGUs and their communities through special development and administrative areas.
- Section 1 requires such special areas to ensure efficient and effective planning, supervision, and coordination of essential basic services.
- Section 1 preserves LGU autonomy by stating that coordination operates without prejudice to the autonomy of the LGUs concerned.
Creation of MBLISTTDA authority
- Section 2 creates the Metropolitan Baguio City, La Trinidad, Itogon, Sablan, Tuba, and Tublay Development Authority (MBLISTTDA) as a government instrumentality.
- Section 2 provides that MBLISTTDA administers a special development and administrative area embracing the City of Baguio and the municipalities of La Trinidad, Itogon, Sablan, Tuba, and Tublay.
- Section 2 places MBLISTTDA under the administrative supervision of the Office of the President of the Philippines.
- Section 2 establishes MBLISTTDA as a unified management platform to accelerate developments by enabling component LGUs to respond to common challenges through unified, effective, and economically efficient programs and undertakings.
- Section 2 requires MBLISTTDA to perform planning, monitoring, and coordinative functions.
- Section 2 grants MBLISTTDA regulatory and supervisory authority over the delivery of area-wide services within the concerned jurisdictions without diminution of autonomy over purely local matters.
Scope: services and area-wide delivery
- Section 3 requires MBLISTTDA services to take into consideration the needs of the population within the territory of the concerned LGUs.
- Section 3(a) covers development planning, including evaluation and packaging of development projects; investment programming and coordination; and monitoring implementation through medium- and long-term development plans.
- Section 3(b) covers urban renewal, land use planning, and housing and shelter, including rationalizing and optimizing urban land use, addressing rehabilitation and development of identified areas, and developing shelter and housing facilities with necessary social services.
- Section 3(c) covers transport and traffic management, including rationalizing existing transport operations, infrastructure requirements, use of thoroughfares, promotion of safe and convenient movement of persons and goods, and administering a single ticketing system.
- Section 3(d) covers solid waste disposal and management, including formulation and implementation of policies, establishment and operation of a sanitary landfill, waste to energy projects, eco-composting facility (ECR), and alternative programs to reduce, reuse, and recycle solid waste.
- Section 3(e) covers flood control and sewerage management through integrated flood control and drainage systems.
- Section 3(f) covers water resource management through comprehensive water resource systems, including establishment and operation of water source development, treatment, distribution, and sewerage system facilities.
- Section 3(g) covers health, sanitation, and pollution control, including promotion of ecological balance and prevention and control of environmental pollution.
- Section 3(h) covers public safety and order, including preparedness for preventive or rescue operations during calamities and disasters, contingency plans, and mobilization of resources for relief operations in coordination with national agencies concerned.
- Section 3(i) covers tourism in the entire MBLISTT area.
Governing MBLISTTDA Council composition
- Section 4 establishes the Metropolitan Baguio, La Trinidad, Itogon, Sablan, Tuba, and Tublay (MBLISTT) Council as the governing board and policy-making body.
- The Council consists of ex officio voting members: the Governor of the Province of Benguet and the Mayors of the City of Baguio and the municipalities of La Trinidad, Itogon, Sablan, Tuba, and Tublay.
- The Council includes ex officio non-voting members: (a) the Vice Mayors of Metropolitan Baguio City and the municipalities of La Trinidad, Itogon, Sablan, Tuba, and Tublay; (b) duly authorized representatives of NEDA, DOTr, DPWH, DOT, DICT, DBM, DHSUD, NCIP, DTI, DA, DENR, DOST, CHED, and PNP; and (c) two (2) private sector representatives appointed by the Council.
- The Council is headed by a Chairman elected from among the regular members, who presides over meetings.
- Section 4 provides for an Administrator as an additional member: the President appoints the Administrator from a list of nominees submitted by the Council.
- The Administrator has a six (6))-year term and continues to hold office at the discretion of the appointing authority, holds the rank and privileges of an Assistant Secretary, and acts as the Chief Executive Officer of MBLISTTDA.
- Section 4 provides that the Administrator and non-ex officio Council members are entitled to allowances and per diems under existing policies, rules, and regulations.
Powers and operational functions
- Section 5 mandates MBLISTTDA to formulate, coordinate, and regulate implementation of medium- and long-term plans and programs for delivery of services, land use, and physical development consistent with national development objectives and priorities.
- Section 5(a) requires medium-term investment programs for MBLISTT-wide services to indicate sources and allocation of funds for priority programs and projects.
- Section 5(b) allows MBLISTTDA to undertake and manage programs and projects for specific services under its jurisdiction subject to Council approval, and to create appropriate project management offices.
- Section 5(c) requires coordination and monitoring of plan/program/project implementation in the City of Baguio and component municipalities, identification of bottlenecks, and adoption of solutions to implementation problems.
- Section 5(d) empowers MBLISTTDA to set traffic policies and coordinate and regulate implementation of traffic management programs and projects, including seeking assistance from other agencies if necessary.
- Section 5(d) authorizes MBLISTTDA to install and administer a single ticketing system, fix, impose, and collect fines and penalties for violations of traffic rules and regulations, and enforce traffic laws and regulations through its Traffic Operation Center.
- Section 5(e) authorizes MBLISTTDA to enter into contracts and own properties, and to receive funding, payments, grants, contributions, and donations.
- Section 5(f) authorizes MBLISTTDA to sue and be sued.
- Section 5(g) allows MBLISTTDA to perform other related functions required to achieve objectives, including delivery of basic services to LGUs when deemed necessary, subject to prior coordination with and consent of the LGU concerned.
Council functions and Administrator duties
- Section 6 requires the Council to exercise MBLISTTDA’s policy-making power.
- Section 6(b) requires the Council to approve plans, programs, and projects and to issue rules and regulations needed to carry out the Act.
- Section 6(c) requires the Council to fix compensation of MBLISTTDA officers and personnel in accordance with the Salary Standardization Law and to approve the annual budget for submission to the DBM.
- Section 6(d) requires the Council to recommend investment programming and supervise implementation of plans and programs, including related activities.
- Section 6(e) requires the Council to set policies and standards and promulgate rules and regulations governing delivery of basic services.
- Section 6(f) requires the Council to endorse the annual and supplemental budgets for submission.
- Section 7 provides that the Administrator executes Council-approved policies and is responsible for efficient and effective day-to-day management.
- Section 7(a) authorizes the Administrator to appoint subordinate officers and employees subject to civil service laws, with security of tenure removable only for cause in accordance with law, and to engage experts or consultants full-time or part-time as required.
- Section 7(b) authorizes the Administrator to discipline subordinate officials and employees under law.
- Section 7(c) requires the Administrator to prepare and submit to the Council the organizational structure and staffing pattern, and to fix number of subordinate officials and employees in accordance with civil service laws and with evaluation and approval of the DBM.
- Section 7(d) requires the Administrator to prepare the annual budget for operations for submission to the Council.
- Section 7(e) requires the Administrator to prepare an annual report of accomplishments for submission to the Council and the President of the Philippines.
- Section 7(f) permits the President or the Council to assign other duties.
Senior managers structure
- Section 8 requires the Administrator to be assisted by a Senior Manager for Operations, a Senior Manager for Planning, and a Senior Manager for Finance and Administration, all appointed by the President as recommended by the Administrator and Council, subject to civil service laws.
- Section 8 provides that the senior managers enjoy security of tenure unless removed for cause in accordance with law.
- Section 8(A) tasks the Senior Manager for Operations to assist administration and supervision of subordinate personnel, assist supervision of operation centers and units, assist in review of plans and programs and preparation of the annual report, and perform other assigned functions.
- Section 8(B) requires the Senior Manager for Planning to have not less than five (5) years extensive experience in development and planning or a master’s degree in Urban Planning or related discipline, and to provide technical assistance, assist in medium- and long-term plan formulation, and perform delegated functions.
- Section 8(C) tasks the Senior Manager for Finance and Administration to assist in preparation of the annual budget, assist in preparation of medium- and long-term investment program for delivery of social services, assist in preparation of budgetary expenditure and sources of financing for programs and operations, and perform other delegated functions.
Implementation linkages and planning interface
- Section 9 requires MBLISTTDA to consult, coordinate, and work closely with public and private institutions, accredited people’s organizations, and nongovernmental organizations operating in the MBLISTT area.
- Section 9 requires MBLISTTDA to formulate a master plan as the framework for development of the MBLISTT area.
- Section 9 requires MBLISTTDA to submit development plans and investment programs to NEDA for integration into the Medium-Term Philippine Development Plan (MTPDP) and the Public Investment Program.
- Section 9 requires MBLISTTDA, in coordination with NEDA and the Department of Finance (DOF), to interface with foreign assistance agencies to obtain financial support, grants, and donations for its programs and projects.
Sources of funds and financial authority
- Section 10(a) requires that the operating budget of MBLISTTDA be included in the annual General Appropriations Act.
- Section 10(b) empowers MBLISTTDA to levy fines and impose fees and charges for various services rendered.
- Section 10(c) provides funding support through financial contributions or technical assistance from member LGUs, NGOs, GOCCs, and the private sector and other local and international organizations in forms including grants, donations, contributions, payments, penalties, fees, and charges.
- Section 10(c) requires prior clearance and approval by the Council and the President of the Philippines or authorized representative, based on the Secretary of Finance’s recommendation, for acceptance of grants in-cash or in-kind from foreign governments or their agencies and instrumentalities, or multilateral institutions or organizations.
- Section 10(c) requires prior clearance and approval by the Council and the President of the Philippines or authorized representative based on the recommendation of the Secretary of Foreign Affairs for acceptance of donations in-cash or in-kind from foreign governments.
Expanding inclusion of adjoining LGUs
- Section 11 allows adjoining LGUs to opt to be included in MBLISTTDA.
- Section 11 requires a Sanggunian Resolution passed for the purpose and duly approved.
- Section 11 further requires concurrence from the MBLISTTDA Council.
Implementing rules and regulations
- Section 12 directs that within ninety (90) days from the approval of the Act, the MBLISTT Council promulgates the necessary rules and regulations to implement the Act.
Separability, repeal, and effective date rules
- Section 13 provides that if any part or provision is held unconstitutional or invalid, the remaining parts not affected continue in full force and effect.
- Section 14 repeals, amends, or modifies all laws, decrees, executive orders, rules and regulations, or parts thereof inconsistent with the Act.
- Section 15 establishes the effective date as fifteen (15) days after publication in the Official Gazette or in a newspaper of general circulation.
