Death Benefit Provisions

  • If a retired justice dies within two years of retirement, their heirs are entitled to receive the difference between the total two-year pension amount and what has already been paid.

Option Between Retirement Benefits and Previous Acts

  • Retiring justices eligible under previous retirement gratuity laws may choose between the benefits provided therein or under this Act.
  • They can only receive benefits from one chosen scheme.
  • Justices retired under prior laws who are later reappointed to the Supreme Court can avail of benefits under this Act.
  • Any previously received gratuity must be fully refunded, with monthly deductions from current benefits, before receiving new benefits.

Appropriations and Funding

  • Necessary funds to implement this Act are appropriated from the National Treasury funds not otherwise allocated.
  • No appropriation entry shall be made until the current year’s required sum is determined by the Auditor.

Effectivity of the Act

  • The Act takes effect immediately upon approval.
