Scope of Work and Reservation of Land

  • Appropriation covers dredging operations where necessary in Cebu harbor.

  • Public lands including reclaimed and adjoining Insular Government lands are reserved for public use.

Contracting Procedures and Material Acquisition

  • Improvement work and procurement of materials should be done by contract with private entities wherever practicable.

Contract Advertisement and Award Procedures

  • Consulting Engineer must advertise bidding for the work or parts thereof, judged most beneficial for public interest.
  • Advertisement to run for 30 days in at least two newspapers: one printed in English, one in Spanish, widely circulated in the Philippines.
  • Authority to reject any or all bids and waive minor defects.
  • If bids are deemed excessive, with Secretary of Commerce and Police approval, the Engineer may purchase materials and hire labor directly and supervise work.
  • Relevant contract letting provisions from section 5(b) to 5(s) of Act No. 22 apply where suitable under Philippine Government regulations.

Plan Preparation and Proposal Solicitation Deadline

  • Consulting Engineer must prepare plans, specifications, and contracts, and advertise for proposals within 60 days from the Act's passage.

Expedited Enactment

  • The Act's passage is expedited under section 2 of the Act prescribing the enactment procedure by the Commission, due to public interest.

Effectivity

  • The Act takes effect immediately upon passage.
