Selection Procedure and Bond Requirements
- The Collector shall advertise for bids specifying the landing costs per passenger and per piece of luggage (both large and small).
- The person or company who offers the lowest bid and is adjudged by the Collector to be of good character and responsible will be awarded the license.
- Before commencing duties, the selected licensee must post a bond to the Philippine Government ensuring:
- Acquisition of adequate equipment such as launches for efficient landing operations.
- Commitment to land all passengers and baggage throughout the contract year.
- Prompt compensation for any losses of baggage or property due to negligence.
- The bond amount and sufficiency are determined and approved by the Collector of Customs.
- The Act preserves passengers' right to recover for personal injury through ordinary courts.
Scope and Definitions
- The Act does not restrict passengers or others from gratuitously landing passengers and baggage.
- The core intent is to restrict the commercial business (for hire) of landing passengers and baggage exclusively to the licensed person or company.
- The term "person" includes firms or companies.
Supervision, Regulation, and License Revocation
- The Collector of Customs holds complete supervision over the contract's execution.
- The Collector is empowered to make reasonable regulations concerning the landing business.
- In case of breach of contract or regulations, the Collector may revoke the license before its expiration.
- Upon revocation, the Collector may award the contract to another qualified person following the bidding process.
Expedited Enactment
- The Act's passage was expedited due to the public necessity, as provided under the procedural Act referenced.
Effectivity
- The Act took effect immediately upon its passage on September 5, 1901.
