Law Summary

Requirements for Changing Local Fiesta Dates

  • A resolution fixing or changing the local fiesta date must be passed by a two-thirds majority of all municipal council members.
  • No change of the fiesta date may be made before five years have elapsed since the last date was fixed.
  • A local fiesta may only be held once each year and must occur exactly on the designated date unless exceptional circumstances justify a change.

Exceptions to Fiesta Date and Frequency

  • The fiesta date may be changed within the same year for weighty reasons such as typhoons, inundations, earthquakes, epidemics, or other public calamities.
  • Such change in date also requires a resolution by the municipal council.

Regulation of Cockfighting during Fiestas

  • The municipal council has authority to regulate, permit, or prohibit cockfighting and the keeping or training of fighting cocks within the municipality.
  • Cockfights may only legally occur in licensed cockpits on legal holidays and during a period not exceeding three days for the local fiesta celebration.
  • Card games or games of chance are prohibited on the premises of cockpits during such events.

Repeal of Previous Conflicting Acts

  • Acts Numbered Nineteen Hundred and Nine and Two Thousand and Fifty-Four are repealed as of the effectivity of this Act.

Effectivity

  • The Act takes effect immediately upon its passage on February 28, 1914.
