Prohibited Acts in Contracting Business
- Contractors must secure a valid license before submitting bids, undertaking construction, or supervising construction projects.
- Penalties for unlicensed contracting include a fine between P100,000 to P500,000 plus 0.1% of project cost and a one-year prohibition from obtaining a license.
- Joint ventures must secure an additional license; failure leads to fines, automatic revocation, and one-year prohibition.
- Managing partners, officers, or employees of licensed entities must obtain individual licenses to engage directly in contracting.
- Use of another’s license, falsification of documents, impersonation, or use of expired/revoked licenses is punishable by fines from P500,000 to P1,000,000 and imprisonment of 1 to 6 years.
- These penalties are without prejudice to other applicable criminal liabilities under the Revised Penal Code or other laws.
Deletion of Sections
- Sections 37 and 38 of the previous law are repealed.
Fees for Licensing and Examination
- Original license fee is set at P5,000.
- Examination fee for applicants is P6,000.
- Renewal fee of license is P5,000.
- The Board has authority to collect and apply all fees and fines to its operations.
- Fee adjustments are allowed once every three years, capped at a 15% increase.
License Renewal Provisions
- License validity is one year from issuance.
- Contractors operational for 25 years or more may renew every three years.
- Those operational between 10 to less than 25 years may renew biennially.
- Those with less than 10 years in operation must renew annually.
- Renewal applications must be filed 30 to 90 days before license expiration and can be submitted in person or online.
Renumbering and Administrative Clauses
- Subsequent sections of the law are renumbered accordingly following deletions.
- Separability clause provides that invalidity of any provision does not affect other valid provisions.
- Repealing clause abrogates inconsistent laws and regulations.
- The law takes effect 15 days after publication in official or widely circulated newspapers.
