Amendments to Sections 4 and 10 of Batas Pambansa Blg. 20 establish the composition and election process for the Sangguniang Pampook in Regions 9 and 12, including the appointment of sectoral representatives, while also transferring assets and liabilities from previous Lupong Tagapagpaganap organizations.

Composition and Appointment of the Merged Lupong Tagapagpaganap

  • The Lupong Tagapagpaganap (Executive Council) for Regions IX and XII is merged and composed of:
    • 1 Chairman
    • 2 Vice-Chairmen
    • 8 Members
  • Representation must ensure every province with its component city or cities in the autonomous area is included.
  • Appointment procedures:
    • Chairman appointed by the President from recommendations by the Sangguniang Pampook of both Regions IX and XII.
    • One Vice-Chairman and four Members appointed upon recommendation from Region IX.
    • One Vice-Chairman and four Members appointed upon recommendation from Region XII.
  • Any elective official appointed as Chairman or Member must vacate their elective position upon assuming the appointive role within 30 days or forfeit the appointment.

Transfer of Assets and Liabilities

  • All records, equipment, buildings, facilities, properties, and liabilities of the Lupong Tagapagpaganap organized under Presidential Decree No. 1618 are transferred to the merged Lupong Tagapagpaganap under Presidential Decree No. 1843 (as amended).

Appropriations

  • Existing appropriations under Batas Pambansa Blg. 131 for the Lupong Tagapagpaganap of Regions IX and XII are transferred to the merged Lupong Tagapagpaganap created under Presidential Decree No. 1843 and its amendment.

Separability Clause

  • Provisions of the Act are declared separable.
  • If any provision is held unconstitutional, it does not affect the validity of the remaining provisions.

Repealing Clause

  • All laws, decrees, executive orders, letters of instruction, and regulations inconsistent with this Act are repealed, amended, or modified accordingly.

Effectivity

  • The Act takes effect immediately upon approval (June 2, 1982).
