Role and Responsibilities of DOLE and LGUs
- LGUs establish PESOs in coordination with DOLE.
- DOLE responsibilities include:
- Technical supervision, coordination, and capacity building of PESOs.
- Establishment and maintenance of computerized job registries and clearance systems.
- Providing technical assistance, training, and support services for PESO personnel.
- Setting operational and personnel qualification standards.
- Extending additional employment services such as job fairs and seminars.
- Monitoring, assessing, and evaluating PESO and job placement office performances.
- Job seekers must register at PESOs for employment assistance.
- Employers are required to submit job vacancies and hired applicants data to PESOs.
- LGUs must establish systems to collect labor market data, including current job statistics and five-year job projections from establishments.
- Labor market data is used by PESOs for job matching and by EIs for student career guidance.
- LGU responsibilities encompass:
- Operating and maintaining PESOs.
- Ensuring compliance with DOLE operational standards.
- Providing employment promotion assistance within their jurisdiction.
- Submitting periodic performance and accomplishment reports to DOLE.
Funding for PESOs and Related Offices
- Funding for PESO operations is sourced from LGUs' internal revenue allotments and internally generated income.
- NGO PESOs and EI job placement offices fund their operations from internally generated income.
- DOLE’s budget, included in the General Appropriations Act, covers technical assistance, training, and supervision.
- Department of Budget and Management incorporates necessary funds for implementation in the annual budget.
Implementing Rules and Regulations
- The Secretary of Labor and Employment is mandated to issue the necessary implementing rules and regulations within 90 days from the law's effectivity.
Legal Provisions
- Separability Clause: Invalidity of any part of the law does not affect the rest of the law.
- Repealing Clause: All inconsistent laws, decrees, executive orders, rules, or regulations are repealed or modified accordingly.
- Effectivity Clause: The law takes effect 15 days after its publication in the Official Gazette or two newspapers of general circulation.
