Legal basis and affected prior law
- Presidential Decree No. 586 is issued pursuant to the President’s constitutional powers as Commander-in-Chief of the Armed Forces of the Philippines.
- The decree is issued pursuant to Proclamation No. 1081 dated September 21, 1972 and General Order No. 1 dated September 22, 1972, as amended.
- The decree amends Republic Act No. 6372, which created the Municipality of Dupax del Sur from the Municipality of Dupax in Nueva Vizcaya.
- The decree repeals, amends, or modifies inconsistent rules, regulations, and issuances to the extent of inconsistency.
Seat of municipal government amended
- Section 1 amends Section 4 of Republic Act No. 6372.
- Section 4 is rewritten to provide that the seat of the municipal government of Dupax del Sur shall be in the old poblacion of Dupax.
- Section 4 further provides that Malasin shall be the seat of the municipal government of Dupax del Norte.
Choice of municipality by incumbent officials
- Section 2 amends Section 6 of Republic Act No. 6372.
- Incumbent elective officials of the present Municipality of Dupax must choose within thirty days from the issuance of this decree the municipality where they want to serve their unexpired term of office.
- The choice is subject to appropriate presidential proclamations, decrees, or letter of instructions.
- Elective positions left vacant after officials indicate their preference shall be filled by appointment by the President of the Philippines.
- Appointed officials shall serve the unexpired term of the office to which they are appointed, again subject to appropriate presidential proclamations, decrees, and letters of instructions.
Repeal of inconsistent issuances
- Section 3 provides that all laws, executive orders, decrees, rules and regulations, or parts thereof inconsistent with the provisions of Presidential Decree No. 586 are repealed, amended or modified accordingly.
Effectivity
- Section 4 states that the decree shall take effect immediately.
