Coverage and franchise grant
- Section 1 of Republic Act No. 3133 amends Section 1 of Republic Act No. 1018 to grant Ang Tibay, Inc., including its successors or assigns, a franchise to construct, maintain and operate in the Philippines.
- The franchise authorizes Ang Tibay, Inc. to operate private fixed point-to-point and land based and land mobile radio stations.
- The franchise covers the reception and transmission of wireless messages on radiotelegraphy or radiotelephony.
- Each station must be provided with a radio transmitting apparatus and a radio receiving apparatus.
- Operation of the franchise is subject to the approval of the Secretary of Public Works and Communications.
Domestic telecommunications limitation
- Section 3 of Republic Act No. 3133 amends Section 3 of Republic Act No. 1018 to prohibit the grantee, its successors or assigns, from engaging in domestic business of telecommunications in the Philippines.
- The franchise purpose is to secure the grantee the right to construct, install, maintain and operate private fixed point-to-point and land based and land mobile radio stations.
- The grantee’s station placement is tied to places within the Philippines as the interest of the grantee may justify.
Repeal of a former provision
- Section 2 of Republic Act No. 3133 repeals Section two of Republic Act No. 1018.
Congressional control over the franchise
- Section 4 of Republic Act No. 3133 amends Section 10 of Republic Act No. 1018 to provide that the franchise is subject to amendment, alteration or repeal by Congress.
- The amendment, alteration, or repeal by Congress is allowed when the public interest so requires.
- The franchise must not be interpreted as an exclusive grant of the privilege herein provided for.
Amended title
- Section 5 of Republic Act No. 3133 amends the title of Republic Act No. 1018 to read:
“An Act granting the Ang Tibay, Inc., a franchise to construct, maintain and operate private fixed point-to-point and land based and land mobile radio stations for the reception and transmission of radio communications within the Philippines.”
