Conditions and Procedures for Reprinting

  • Only one authorized private publisher or printer per particular book title can undertake reprinting.
  • Applicants must file an application with the National Library including: title, author, original publisher, foreign list price (if Philippine book), proposed list price of reprint, name of printer, number of copies, and applicant's name and address.
  • Applications for subsequent reprintings are required with copies sent to local representatives of foreign publishers.
  • Reprinting must be completed within 60 days from approval; failure allows others to apply.
  • "Exorbitant price" is defined as not less than Thirty-Five Pesos (P35.00) per unit or as increased by the Reprint Committee.
  • Each reprinted copy must be consecutively numbered on the copyright page.
  • Books reprinted before these amendments must register with the National Library within 30 days.

Markings and Export Restrictions

  • Reprinted books must properly acknowledge source, authorship, copyright holders, previous printers (if known), and publishers/printers' names and addresses.
  • Any abbreviation or editing must be declared.
  • A mandated inscription "Export of this Book or material is punishable by law" must appear on the cover.
  • Export of reprinted books is strictly prohibited.
  • Violators found exporting reprints face penalties and disqualification from future reprinting with license cancellation.

Royalty Payments

  • Reprinters must pay royalties to copyright owners:
    • At least 7% of Philippine list price for locally published books.
    • At least 2% of the foreign list price for foreign-published books.
  • Sales reports and royalty payments are submitted semi-annually.
  • For non-resident copyright owners, royalties may be remitted in dollars.

Dispute Resolution and Implementation

  • The Reprint Committee resolves conflicts or claims arising under the decree.
  • Committee decisions become final 15 days after receipt unless appealed to the Office of the President.
  • The Committee is authorized to issue and enforce necessary rules and regulations for effective implementation.

Penalties for Violations

  • Violators face imprisonment from six months to three years, or fines from Ten Thousand to Fifty Thousand Pesos, or both.
  • In corporate violations, responsible officers (directors, managers) are held liable, and the corporation pays fines.
  • Books printed, published, or exported illegally are confiscated.
  • Establishments involved in violations shall be closed and barred from operations.

Effectivity

  • The amendments take effect immediately upon promulgation on September 27, 1977.
