Legal basis and amendatory scope
- Republic Act No. 2625 amends Sections 284 and 285-A of the Administrative Code, as amended.
- The amendments apply to leave entitlements under Section 284 (vacation leave) and Section 285-A (sick leave).
Policy, purpose, and intent statement
- Republic Act No. 2625 provides that vacation leave and sick leave computations exclude Saturdays, Sundays and holidays.
Definitions and covered persons
- Section 284 covers employees or laborers—whether permanent or temporary—of:
- the National Government,
- the provincial government,
- the government of a chartered city,
- the government of a municipality,
- the municipal district, and
- government-owned or controlled corporations (with stated exclusions by reference).
- Section 285-A covers employees or laborers—whether permanent or temporary—of:
- the National Government,
- the provincial government,
- the government of a chartered city,
- the municipality,
- the municipal district in any regularly and specially organized province (with stated exclusions by reference).
- Section 285-A limits sick leave to sickness affecting:
- the employee or laborer concerned, or
- any member of his immediate family.
Vacation leave computation rule
- Section 284 requires at least six months’ continuous faithful, and satisfactory service before vacation leave may be granted.
- Section 284 authorizes the President, the proper head of department, or the chief of office (for municipal employees) to grant vacation leave in his discretion.
- Section 284 grants fifteen days vacation leave of absence with full pay for each calendar year of service.
- Section 284 makes the leave entitlement exclusive of Saturdays, Sundays and holidays.
Sick leave computation rule
- Section 285-A provides sick leave in addition to the vacation leave provided in the immediately preceding provisions.
- Section 285-A grants fifteen days of sick leave for each year of service with full pay.
- Section 285-A makes the sick leave entitlement exclusive of Saturdays, Sunday and holidays.
- Section 285-A requires sick leave to be granted by the President, Head of Department, or independent office concerned, or by the chief of office for municipal employees.
- Section 285-A limits granting of sick leave to cases of sickness on the part of the employee or laborer concerned or any member of his immediate family.
Exclusions and referenced categories
- Section 284 grants leave only to employees or laborers in organizations covered other than those mentioned in Section 268, Section 271 and Section 274 of the Administrative Code.
- Section 285-A grants sick leave only to employees or laborers in organizations covered other than those mentioned in Section 268, Section 271 and Section 274 of the Administrative Code.
- Section 285-A covers municipal districts within regularly and specially organized provinces, consistent with its stated scope.
Effective date
- Republic Act No. 2625 takes effect upon approval (June 17, 1960).
