Conditions for Transfer of Homestead Rights Prior to Patent Issuance
- Transfer permitted only if the applicant proves compliance with legal requirements to the satisfaction of the Director of Lands.
- Applicant must be unable to continue with the homestead due to reasons beyond their fault.
- There must be a bona fide purchaser for the applicant's rights and improvements on the land.
- The conveyance must not be for speculative purposes.
- Transfer requires prior approval from the Director of Lands.
Eligibility and Procedure Following Transfer
- The transferee must be legally qualified to apply for a homestead.
- Upon transfer approval, the purchaser must immediately file a homestead application for the acquired land.
- The purchaser succeeds the original homesteader's rights and obligations starting from the date of the purchaser's application approval.
Restrictions and Consequences of Unauthorized Transfers
- Applicants who have transferred their rights cannot apply for a new homestead.
- Transfers made without the Director of Lands' prior approval are null and void.
- Unauthorized transfers lead to cancellation of the entry and refusal to issue a patent.
Repeal of Conflicting Laws
- Any laws, provisions, or regulations inconsistent with this amendment are repealed.
Effectivity
- The Act takes effect immediately upon approval.
