Conditions for Direct Negotiated Sale of Lands

  • Direct negotiated sale without public bidding is permitted for lands owned by the National Government or LGUs, subject to these conditions:
    • The land must be in a residential zone as classified by the LGU.
    • The land must be certified for socialized housing by the Housing and Urban Development Coordinating Council.
    • Occupants must be qualified beneficiaries per Section 16 and registered according to Section 17 of the Urban Development and Housing Act.
    • Pricing must be affordable considering occupants' income and land valuation requirements under Section 13.
    • Any resale or subsequent disposition is subject to limitations under Section 14.
    • Occupants must have resided on the land, adhering to prohibitions under Section 31.

Separability Clause

  • If any provision of the Act is declared unconstitutional or invalid, other unaffected provisions remain fully effective.

Repealing Clause

  • All laws, presidential decrees, executive orders, rules, and regulations inconsistent with this Act are repealed, amended, or modified accordingly.

Effectivity Clause

  • The Act takes effect fifteen (15) days after publication in at least two newspapers of general circulation.
