Issuance of Marriage License After Notice Period

  • The marriage license shall be issued after the ten-day posting period has expired.

Exceptions to the Mandatory Posting Requirement

  • If an applicant and a priest or minister of the applicant's religion provide a written and sworn statement that the religious rules require banns or publications and that the church complies with these rules with a certificate from the Director of the Philippine National Library:
    • The local civil registrar is not required to make the public posting.
    • The marriage license may be issued immediately after filing the application.
    • The application must state the church, sect, or religion where the marriage will be solemnized.

Another Exception: Parental or Guardian Accompaniment

  • If the father, mother, guardian, or person in charge of each applicant accompanies them during the license application (regardless of the applicants' ages):
    • The public notice is not necessary.
    • The license is issued immediately after executing a document in duplicate signed by these accompanying persons.
    • One copy of this document is attached to the license and the other is filed.

Applicability of Penalties for Violation

  • Any violation of this Act shall be subject to the penalties provided in Section 44 of the Marriage Law.

Effectivity

  • The Act took effect immediately upon approval on November 11, 1931.
