Legal basis and amended provision

Policy and purpose
- Republic Act No. 1095 establishes eligibility qualifications for persons running for provincial office by amending Section 2071 of the Revised Administrative Code.
Qualifications for provincial officer
- Section 2071 provides that no person shall be eligible to a provincial office unless the person meets all listed qualifications at the time of the election.
- A candidate must be a qualified voter of the province at the time of the election.
- A candidate must have a bona fide residence in the province for at least one year prior to the election.
- A candidate must be at least twenty-five years of age at the time of the election.
Mandatory eligibility rule
- Section 2071 makes all listed requirements conditions of eligibility for provincial office and applies at the time of the election.
- Section 1 preserves the mandatory eligibility structure by using an express prohibition: “no person shall be eligible.”
