Republic Act No. 4116 establishes a fixed period for the opening of the school year in the Philippines, ensuring a minimum of forty weeks of schooling and allowing the Secretary of Education to determine the duration of the long school vacation period.

Law Summary

Fixed Period for School Opening

  • The opening date of the school year shall be determined by the Secretary of Education.
  • The opening date must fall no earlier than June 1 and no later than July 31 each year.
  • For the school year 1964-1965, the prescribed calendar by the Secretary of Education shall be observed.
  • From the school year 1965-1966 onwards, the opening date shall comply with the fixed period stated in this Act.

Regulation of Long School Vacation

  • The Secretary of Education shall also fix the long school vacation period.
  • Considerations in fixing the vacation period include the convenience of pupils and their parents as well as prevailing climatic conditions.
  • Vacation dates shall not be changed more frequently than once every five years without:
    • A prior public hearing that is properly advertised in newspapers of general circulation and/or
    • Announcements by local authorities.

Appeals and Enforcement

  • Any order by the Secretary of Education changing the long school vacation period may be appealed to the National Board of Education.
  • Such changes shall not be enforced while an appeal is pending.

Authorization of Additional Special School Holidays

  • Beyond the legal holidays, the Secretary of Education may authorize the observance of other special school holidays in public and private schools.

Effectivity

  • The Act takes effect immediately upon its approval.
