Limitations on Lot Sizes
- Agricultural subdivision lots shall not exceed:
- 5 hectares for coconut lands.
- 10 hectares for improved abaca lands.
- 12 hectares for unimproved lands.
- Urban homesite or residential lots shall not exceed 1,000 square meters.
- Despite statutory limits, the Department of General Services determines the minimum size of urban homesite/residential lots.
- Lot allotment to priority occupants existing at the time of Act approval.
Sales and Disposal Procedures for Subdivided Lands
- Sales of subdivided lots (excluding commercial and industrial lots) by NAFCO are exempt from the sales application, publication, and public auction requirements normally mandated under Sections 24-26 of Commonwealth Act No. 141 (Public Land Law).
- Sales made prior to this Act without such formalities are ratified and confirmed.
Priority in Lot Acquisition
- First priority is given to bona fide occupants on or before December 12, 1946.
- Second priority to war veterans, guerrilla members, and other qualified persons who entered the land between December 13, 1946 and December 31, 1953.
- These second priority persons are limited to acquiring only the area they have actually improved and maintained.
Disposal of Unoccupied Lots
- Any subdivided lots remaining unoccupied shall be disposed of by drawing lots among qualified applicants.
Effectivity
- The Act took effect immediately upon approval.
- Enacted without executive approval on June 18, 1961.
