Procedure for Petitions for Review
- The Supreme Court is mandated to prescribe, via the Rules of Court, the procedures governing petitions for review to the Court of Appeals.
- Pending the establishment of such rules, petitions for review must:
- Be filed within the applicable periods for appeal in civil or criminal cases depending on the case nature.
- Not stay the judgment sought to be reviewed unless authorized by the Court of First Instance or Court of Appeals for good cause and just terms.
- Be filed and proceeded with, as far as practicable, following the manner and form of Rules 43 and 44 of the Rules of Court.
Effectivity and Non-Retroactivity
- The Act takes effect immediately upon approval.
- The Act does not affect appeals that were already perfected before its approval, preserving prior appellate actions without disturbance.
