Classification of Mischief Based on Damage Value
- The penalty imposed depends on the monetary value of the damage caused by the mischief.
- Damage is assessed in Philippine Pesos (PHP).
Penalty for Damage Exceeding 1,000 Pesos
- If the damage caused exceeds 1,000 pesos, the offender shall be punished by arresto mayor in its medium and maximum periods.
Penalty for Damage Over 200 Pesos but Not Exceeding 1,000 Pesos
- If damage is over 200 pesos but does not exceed 1,000 pesos, the penalty is arresto mayor in its minimum and medium periods.
Penalty for Damage Not Exceeding 200 Pesos or Unestimable Amount
- When the damage amount does not exceed 200 pesos, or the value cannot be estimated, the penalty shall be:
- Arresto menor; or
- A fine ranging from not less than the value of the damage caused to not more than 200 pesos.
Definitions of Penalties
- Arresto mayor refers to a penalty of imprisonment ranging from one month and one day to six months.
- Arresto menor refers to a lighter penalty of imprisonment ranging from one day to thirty days.
- The distinction among minimum, medium, and maximum periods brings gradation within the penalties depending on the severity of the offense.

- This amendment took effect immediately upon its approval on December 5, 1932.
