Legal basis and subject of amendment

Subsection (e): penalized hotel-related conduct
- Article 315, paragraph two, subsection (e) penalizes obtaining any food, refreshment or accommodation at a hotel, inn, restaurant, boarding house, lodging house, or apartment house and the like without paying therefor.
- The penalized act requires intent to defraud the proprietor or manager of the establishment.
- Article 315, paragraph two, subsection (e) also penalizes obtaining credit at such establishments by the use of any false pretense.
- The penalized act further covers abandoning or surreptitiously removing any part of his baggage from a hotel, inn, restaurant, boarding house, lodging house, or apartment house after obtaining credit, food, refreshment, or accommodation therein without paying.
- The scope of the conduct is tied to transactions involving credit, food, refreshment, accommodation, and baggage in the enumerated lodging and hospitality settings.
