Circumstances Elevating Theft to Qualified Theft
- Theft is considered qualified and subject to higher penalties when committed under the following conditions:
- By a domestic servant.
- With grave abuse of confidence.
- When the property stolen is a motor vehicle, mail matter, or large cattle.
- When the stolen property consists of coconuts from a plantation.
- When fish are stolen from a fishpond or fishery.
- When property is taken during or on the occasion of specific calamities such as fire, earthquake, typhoon, volcanic eruption, or other calamities.
- When taking property occurs during vehicular accidents or civil disturbances.
Penalties for Qualified Theft
- The penalties prescribed for qualified theft are two degrees higher than those specified for ordinary theft in the immediately preceding article of the Revised Penal Code.
Legal Effectivity
- The act took effect immediately upon its approval on May 1, 1980.
