Limitation on Accumulated Leave

  • The total leave (vacation and sick combined) that can be accumulated by any government officer or employee is capped at ten months.

Discretionary Commutation by Department Head

  • The Department Head may authorize commutation of salary equivalent to the leave period for appointed officers, employees, teachers, or laborers.
  • Payment should be made on or before the start of the leave and charged to the fund from which the salary is normally paid.

Reemployment Restrictions After Leave Commutation

  • Persons whose leave has been commuted upon separation from government service cannot be reappointed or reemployed before the expiration of the commuted leave period.
  • Early reappointment or reemployment is possible only if the employee refunds the monetary value of the unexpired portion of the commuted leave.

Implementation

  • The Act takes effect immediately upon approval, ensuring the amendment to the Administrative Code regarding leave accumulation and commutation is enforceable from that time.
