Law Summary

Compensation When Vice-Mayor or Councilor Acts as Mayor

  • If the mayor is absent, suspended, or disabled and ceases to perform his duties, the vice-mayor or councilor acting as mayor shall receive compensation equivalent to the mayor's salary for the period of service.

Full Salary for Mayor During Authorized Absences

  • The mayor shall receive full salary when absent from the municipality due to:
    • Attendance at any meeting of mayors convened by the provincial board
    • Other official business required by law or competent administrative authority
    • Illness contracted through no fault of the mayor, with conditions:
      • Absence does not exceed thirty days within a year
      • Illness is attested by affidavit and medical or health officer's certificate
  • During such absences, if the vice-mayor or councilor serves as acting mayor, he shall receive compensation equal to the mayor's salary for the period.

Limitations and Conditions on Compensation

  • Per diem for council sessions shall not be paid to vice-mayor or councilor rendering mayoral service during the mayor's absence.
  • If compensation to the acting mayor exceeds fifty percent of the mayor's basic salary in a year, the excess amount shall be paid from the mayor's salary.

Travel Expenses for Vice-Mayor and Councilors

  • When vice-mayor and councilors are absent from their permanent stations on official business other than council session attendance, they are entitled to actual travel expenses.

Repeal of Inconsistent Laws

  • All previous Acts, executive orders, or parts inconsistent with this Act are repealed.

Effectivity

  • The Act takes effect upon approval on June 16, 1956.
