Sentencing Provisions for Habitual Criminals
- Third conviction: The person shall be punished with the penalty prescribed for the last crime committed plus an additional penalty ranging from three to nine years, subject to court discretion.
- Fourth conviction: The sentence includes the penalty for the latest crime plus an additional imprisonment ranging from ten to fifteen years.
- Fifth conviction: The latest crime's penalty is coupled with an additional penalty of sixteen to twenty years.
- Sixth or subsequent convictions: The offender shall face the penalty for the last offense plus an additional imprisonment of twenty-one to thirty years.
Limit on Total Imprisonment
- Notwithstanding the cumulative penalties, the total imprisonment imposed under this law shall not exceed thirty years.
Amendment and Effectivity
- This Act amends subsection (d) of Section 1 of Act No. 3397 regarding additional penalties for habitual criminals.
- The law took effect upon approval on November 27, 1929.
