Law Summary

Definition and Role of Physicians in Brain Death Certification

  • Brain death must be established by two (2) physicians.
  • These physicians are preferably neurologists, neurosurgeons, internists, or anesthesiologists but are not limited to these specialties.
  • The determination of brain death must adhere to the 2017 PNA Revised Brain Death Criteria.

Required Interval Between Brain Death Evaluations

  • A second evaluation must be conducted by the same two physicians to confirm brain death.
  • The time interval between the first and second examinations is extended to at least four (4) hours, an increase from the previous minimum of two (2) hours.
  • This procedure aligns with the 2017 PNA Revised Brain Death Criteria.

Death Certification and Time of Death Determination

  • The Attending Physician (AP) is responsible for signing the Death Certificate.
  • The date and time of death must be recorded both on the Death Certificate and in the patient's medical chart.
  • The legally recognized time of death is when the second declaration of brain death is made, replacing the previous rule of using the first declaration time.

Continuity and Implementation of the Administrative Order

  • All other provisions of DOH Administrative Order No. 2010-0019 remain effective and unchanged.
  • The amendment will take effect fifteen (15) days after its publication in the Official Gazette or a newspaper of general circulation.
  • This amendment ensures legal and medical consistency in the process of brain death certification pertinent to deceased organ donation in the Philippines.
