Legal basis and prior issuance
- DENR Administrative Order No. 05 amends Section 2 of DENR Administrative Order No. 19, Series of 1989.
- The operative change is limited to the exemption clause in Section 2 of DENR Administrative Order No. 19, Series of 1989.
Policy and purpose
- DENR Administrative Order No. 05 is issued to encourage processing of high value added lumber products.
- DENR Administrative Order No. 05 is also issued to discourage technical manipulation in the implementation of the lumber export ban.
Amended exemption from export ban
- Section 2 establishes an exemption to the export ban for certain lumber products and related wood outputs.
- Lumber products, wood manufacturers, and other wood finished products that are further manufactured from lumber or wood are allowed to be exported.
- The exemption covers products coming from local or imported logs.
- The exemption applies to specified finished products, including wooden furniture and toys, packing cases and parquet floors, doors and other builder woodworks, picture frames, tool handles, decorative articles, wooden shoes, toothpicks, and chopsticks.
- The exemption expressly includes other items “including, but not limited to” those listed, so it is not limited to the enumerated examples.
Scope and coverage rules
- The exemption applies to lumber products, wood manufacturers, and other wood finished products that meet the “further manufactured from lumber or wood” requirement.
- The exemption covers finished products derived from local logs or imported logs.
- The exemption includes both raw-to-finished processing outputs (further manufacturing from lumber/wood) and final wood finished products identified by examples.
Implementation effect
- DENR Administrative Order No. 05 amends only the wording of the exemption in Section 2 of DENR Administrative Order No. 19, Series of 1989.
- All other provisions of DENR Administrative Order No. 19, Series of 1989 remain in force as before.
