Regulations on Sale and Dispensing of Medicines and Drugs
- Medicines, pharmaceuticals, drugs, and devices may only be compounded, dispensed, sold, or made available to the public through:
- A prescription drugstore or hospital pharmacy that is duly established under this Act.
- Manufacturers, importers, and wholesalers of pharmaceuticals and biological products may sell their products only to:
- Retail drugstores, hospital pharmacies, or other wholesalers supervised by registered pharmacists.
- Such establishments must be duly licensed and in compliance with the Retail Trade Law.
Requirements for Opening and Operating Drugstores and Pharmacies
- Minimum requirements for opening and operating drugstores and pharmacies shall be established by the Food and Drug Administration (FDA) through rules and regulations aligned with the Act.
- Any application for the opening of a retail drugstore requires the signature of a Filipino registered pharmacist, either as the owner or as the supervising pharmacist.
- This requirement ensures Filipino oversight and supervision in pharmaceutical retail establishments pursuant to Section 27 of the Pharmacy Law.
Effect on Existing Laws and Regulations
- Any existing law, rule, or regulation that conflicts with this Decree is hereby modified or repealed accordingly.
This amendment aims to clarify and ensure equal opportunities for Filipinos in pursuing the pharmacy profession and regulating the sale of medicines and drugs, promoting professionalism and safeguarding public health through rigorous standards in education, internship, licensing, and operation of pharmacies.
