The Department of Labor and Employment (DOLE) issued an amendment to Department Order No. 12, Series of 2001, deleting Rule I, Paragraph 1.6 and adding exemptions for foreign nationals teaching or seeking employment in the Philippines, which will take effect after fifteen days of publication.

Amendments to the Exemption Provisions Under Rule I, Paragraph 2

  • The Exemption section (Paragraph 2) of Rule I is amended to include two new subparagraphs, 2.6 and 2.7, which specify additional categories of foreign nationals exempted from the employment permit requirement.

  • Subparagraph 2.6:

    • Applies to foreign nationals who come to the Philippines as visiting, exchange, or adjunct professors.
    • Such foreign nationals must be engaged in teaching, presenting, and/or conducting research studies.
    • Engagement must be under formal agreements between Philippine universities or colleges and foreign educational institutions or foreign governments.
    • The exemption is subject to reciprocal treatment between the involved institutions or governments.
  • Subparagraph 2.7:

    • Exempts resident foreign nationals who are already employed or are seeking employment within the Philippines from needing separate employment permits.

Repeal or Modification of Inconsistent Rules

  • All rules, guidelines, and procedures that are inconsistent with these amendments are hereby repealed or modified to conform with the current changes.

Effectivity of the Amended Guidelines

  • The amended guidelines shall take effect fifteen (15) days after their publication in two newspapers of general circulation, ensuring adequate public notice and compliance period.
