Distribution of General/Flag Officers by Rank

  • Fixed percentage allocation of general/flag officers by grade:
    • General/Admiral (0-10): 1%
    • Lieutenant General/Vice Admiral (0-9): 7%
    • Major General/Rear Admiral (0-8): 30%
    • Brigadier General/Commodore (0-7): 62%
  • Only one officer shall hold the rank of General/Admiral at any time.
  • Percentages for the higher ranks set as maximum numbers.
  • Vacancies in higher ranks can be shifted as increased allocation in lower ranks.
  • Promotion to Brigadier General/Commodore or higher must coincide with existing vacancies and appropriate TOE positions.

Determination and Allocation of Key Positions

  • The Secretary of National Defense, recommended by AFP Chief of Staff, decides key position numbers among services.
  • Allocation considers technical nature, responsibilities, equipment, threats, and service exigencies.
  • Allocations subject to Congressional review.

Promotion and Designation/Assignment Procedures

  • Promotions to Brigadier General/Commodore or higher require:
    • Existing vacancies.
    • Officer occupying TOE position requiring targeted rank.
  • President nominates and appoints officers from Colonel or Naval Captain rank upwards with Commission on Appointments’ consent.
  • The President can make recess appointments effective until disapproved or next Congress adjournment.

Appropriations for Implementation

  • Initial implementation funding from AFP appropriations savings.
  • Subsequent funding included in AFP regular annual General Appropriations Act.

Rules and Regulations Issuance

  • Department of National Defense, AFP, and relevant offices formulate implementing rules.
  • Rules necessary to ensure effective enactment of the Act.

Transitory Provisions for Current Officers

  • Officers holding key positions before the Act's effect may be promoted even with less than one year of active service left.
  • Must have held the position for at least six months before the law's effectivity.

Repealing Clause

  • Sections 1 and 2 of Republic Act No. 8186 and inconsistent legislation, rules, or regulations are repealed or modified accordingly.

Effectivity

  • The Act takes effect fifteen days after publication in the Official Gazette or two newspapers of general circulation, whichever is earlier.
