Employment Restrictions for Children Under 16 Years
- Children under 16 are barred from working in industrial undertakings including:
- Mines, quarries, and mineral extraction.
- Manufacturing, repairing, ornamentation, or demolition.
- Shipbuilding and energy generation/transmission.
- Building and civil engineering works.
- Transport and handling of goods at docks, warehouses, or airports.
- Prohibited specifically from operating machinery, working underground, or similar hazardous work.
- Employment forbidden in gambling venues, bars, night clubs, stadiums, and similar places.
Work Hours and Night Work Restrictions for Children and Young Persons
- Children below 16 may only work up to 7 hours daily or 42 hours weekly.
- Night work (6:00 PM to 7:00 AM) is prohibited for children under 16.
- Young persons aged 16-18 are also prohibited from night work in establishments.
- Exceptions to night work restrictions allowed only under conditions specified by International Labor Convention No. 90.
Employment Restrictions and Conditions for Women
- Women of all ages prohibited from jobs requiring continuous standing or heavy lifting.
- Night work prohibition (10:00 PM to 10:00 AM) in industrial establishments applies to all women except family members of owners/operators.
- Exceptions to night work prohibition can be granted:
- For force majeure (unexpected, non-recurring work interruptions).
- To preserve perishable raw materials upon Secretary of Labor’s approval.
- By the President during national emergencies after consultations.
- Women cannot work in non-industrial commercial endeavors at night (midnight to 7:00 AM) except family members.
- Women working agricultural night shifts must receive a rest period of at least 9 consecutive hours.
- Women in managerial, technical, health, or welfare positions are exempt from night work prohibitions.
- Employers must ensure no sex discrimination in employment terms, including equal pay for equal work.
- Women aged 18 and above must be given an 11-hour consecutive rest period between work periods.
Effective Date
- The Act takes effect immediately upon approval on June 19, 1971.
