Amendment to Philippine Law removes reporting requirement for medical practitioners to the Philippine Constabulary, instead mandating reporting to civilian authorities, in order to track violent crimes and conduct timely investigations while respecting the freedoms of medical practitioners.

Law Summary

Coverage of Medical Practitioners and Scope of Injuries

  • Applies to physicians in hospitals, clinics, sanitariums, or other medical establishments.
  • Injuries covered are as defined in Articles 262, 263, 264, and 265 of the Revised Penal Code.

Required Contents of the Medical Report

  • The report should include, when practicable: a) Patient's name, age, and address. b) Name and address of the patient’s nearest kin. c) Name and address of the person who brought the patient for treatment. d) Nature and probable cause of the injury. e) Approximate time and date the injury was sustained. f) Place where the injury occurred. g) Time, date, and nature of the treatment. h) Diagnosis, prognosis, and/or disposition of the patient.

Rulemaking Authority and Collaboration

  • Secretary of Health, in consultation with the Philippine Constabulary, is tasked to promulgate necessary rules and regulations for implementing the law.

Penalties and Administrative Sanctions

  • Violations of the Act or implementing regulations punished administratively.
  • Fine ranges from P100 to P500 per violation.
  • License or permit cancellation upon third violation.
  • Board of Medicine has original and exclusive jurisdiction over violations.
  • Decisions by the Board subject to review by the Professional Regulation Commission upon appeal.

Repeal of Conflicting Laws and Immediate Effect

  • All inconsistent laws, decrees, proclamations, instructions, or parts thereof are repealed or modified accordingly.
  • The Executive Order takes effect immediately upon issuance.
