Scope of reorganizational powers expanded
- Section 2 adds further sub-paragraphs to Paragraph 2 of Presidential Decree No. 1416.
- The President may:
- Create, abolish, group, consolidate, merge, or integrate National Government entities, agencies, instrumentalities, and units.
- Expand, amend, change, or otherwise modify the powers, functions, and authorities of these entities.
- With respect to government-owned or controlled corporations, the President may also modify their:
- corporate life
- capitalization
- other relevant aspects of their charters
- The President may take such other related actions as may be necessary to carry out the purposes and objectives of the Decree.
Effect of executive orders issued under the decree
- Section 3 inserts a new Paragraph 3 into Presidential Decree No. 1416.
- Executive Orders issued by the President pursuant to the reorganization authority have the effect of:
- repealing
- amending or modifying
- accordingly, all laws, decrees, charters, executive orders, administrative orders, proclamations, rules and regulations, or parts thereof that are in conflict with such Executive Orders.
Repeal and modification of conflicting issuances
- Section 4 provides a repealing clause.
- All laws, decrees, charters, executive orders, administrative orders, proclamations, rules and regulations, or parts thereof that conflict with Presidential Decree No. 1772 are repealed or modified accordingly.
Immediate effectivity
- Section 5 states that Presidential Decree No. 1772 takes effect immediately.
- The Decree is signed and dated in the City of Manila on January 15, 1981, by Ferdinand E. Marcos, President of the Philippines, with Juan C. Tuvera as Presidential Executive Assistant.
