Effectivity and publication rule
- The Regulation takes effect fifteen (15) days after its publication in two (2) newspapers of general circulation.
- The effectivity rule applies to the entire Regulation, including the amended bus stop coverage and the penalty provision.
- The implementing rules and regulations required by the Regulation are to be prepared and issued immediately upon the effectivity of this Regulation.
Policy purpose and congestion control
- The Regulation addresses urgent traffic congestion along EDSA caused by undisciplined and misbehaving bus passengers and drivers.
- The Regulation requires bus drivers and passengers to follow proper bus stops and loading and unloading procedures.
- The Regulation is designed to reduce or minimize traffic congestion along EDSA and other minor bus routes.
- The Regulation introduces the Modified Bus Segregation Scheme.
Legal basis and what it amends
- Sections 1 and 3 of MMA Ordinance No. 18, Series of 1991 are amended to implement the Modified Bus Segregation Scheme and its penalties.
- Inconsistent provisions are removed by repealing, modifying, or amending them accordingly under Section 2 of MMDA Regulation No. 97-005.
- The Regulation expressly relies on Section 6 of Republic Act No. 7924 as authority for adoption and promulgation.
Coverage and Modified Bus Segregation Scheme
- Bus stops at selected portions of EDSA and other major bus routes are segregated into two locations or more as identified by CTTM-MMDA.
- Segregated bus stops are based on the origin and destination of bus routes approved by the Land Transportation Franchising and Regulatory Board (LTFRB).
- Allocation of routes at locations with split stops is designated numerically for northbound and southbound buses.
- Appropriate stickers are provided to serve as a conduct of pass or permit for buses to operate along EDSA and other routes that may be subsequently included and designated by the Chairman, MMDA or the Executive Director, CTTM-MMDA.
- The Head of the Center for Transport and Traffic Management, MMDA, in coordination with concerned LGUs and agencies, prepares and issues the implementing rules and regulations immediately upon the Regulation’s effectivity.
Penalty for driver violations
- Any bus driver who violates a provision of MMDA Regulation No. 97-005 is punished by a fine of PHP 1,000.00.
- The penalty is stated as a monetary fine tied to a driver violation of the Regulation’s provisions.
Repeal of inconsistent rules
- Provisions of existing ordinances, rules, and regulations, or portions thereof, that are inconsistent with MMDA Regulation No. 97-005 are repealed, modified, or amended accordingly.
- The repeal/modification is limited to what conflicts with the amended bus stop coverage and the stated penalty rule.
